The North Carolina Department of Public Instruction (NCDPI) is making available its annual State Application for receiving grant award under Part B of the Individuals with Disabilities Education Act (IDEA) as amended in 2004.  The proposed application will be available for public review March 24, 2022 – May 25, 2022.  Comments will be accepted March 24, 2022 – April 25, 2022.  
The North Carolina Department of Public Instruction (NCDPI) is seeking public comments on its proposal to revise three State Determined Performance Levels (SDPLs) for Perkins V Performance Indicators to comply with The Strengthening Career and Technical Education for the 21st Century Act (Perkins V) Section 113 (b)(3)(B)(ii) and North Carolina General Statutes (115C Article 10).
Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will submit a waiver from the requirement under Sec. 1111(c)(4)(E), to calculate the academic achievement score of the accountability model under Sec. 1111(c)(4)(B)(i) based on 95% of students in a school when the actual percentage of students participating is less than 95%. This waiver applies to only the high school reading and mathematics assessments under Sec. 1111(b)(2)(B)(v)(I)(bb) where students were unable to participate in required tests in the 2020-21 school year. Since North Carolina uses a cohort model for participation in high school (reading at grade 10 and mathematics at grade 11), test participation from the 2020-21 school year will have a negative impact on the schools that were unable to assess at least 95% of students in the 2020-21 school year. 
Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will submit an addendum of Section 1111 of the ESEA. The addendum will allow North Carolina to amend the ESEA consolidated State plan for the 2021-22 school year only, providing new provisions to the accountability determinations and school identifications.
Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will submit a request for waiver of section 34 C.F.R §200.6(c)(2) as it requires State Education Agencies to adhere to a 1.0 percent cap for the total number of students assessed Statewide in a subject area using an alternate assessment. Specifically, the state anticipates that it will exceed the cap under paragraph (c)(2) with respect to any subject for which assessments are administered under §200.2(a)(1) in any school year, and is requesting, pursuant to 34 C.F.R §200.6(c)(4), that the Secretary waive the cap for the relevant subject for one year.

The North Carolina Department of Public Instruction (NCDPI) is seeking public comment on its Performance Indicators for Perkins V. To comply with the Carl D. Perkins Career and Technical Act of 2019 Section 113 (b)(3)(B)(ii) and North Carolina General Statues (115C Article 10), public hearings on the state plan performance indicators for Career and Technical Education will be conducted for the purpose of providing opportunities for interested citizens to express their views on (a) the improvement of performance of all CTE concentrators, including subgroups of students, as described in section 1111(h)(1)(C)(ii) of the Elementary and Secondary Education Act of 1965, and special populations, as described in section 3(48); (b) these indicators support the needs of the local education and business community.

Perkins Career and Technical Act of 2019 Section 122 (a)(4) and North Carolina General Statues (115C Article 10), public hearings on the state plan for Career and Technical Education will be conducted for the purpose of providing opportunities for interested citizens to express their views on (a) the goals reflected in the state plan; (b) the program to be offered in the plan; (c) the allocation of responsibility for programs to be offered in the various levels of education and instruction; (d) the processes for transactions to fully comply with the Perkins Act of 2019 and the allocation of local, state, and federal resources to meet these goals.
The North Carolina Department of Public Instruction (NCDPI) Is seeking public comment on its application to the U.S. Department of Education for the Educational Flexibility (Ed-Flex) Program. This program, reauthorized by the Every Student Succeeds Act (ESSA), permits State Educational Agencies (SEAs) to waive certain requirements that may impede local efforts to reform and improve education systems.  With this flexibility, SEAs can waive select requirements of federal statute or regulations that apply to school districts and schools without first submitting those waivers to the Department.
