Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will submit a request for waiver of section 34 C.F.R §200.6(c)(2) as it requires State Education Agencies to adhere to a 1.0 percent cap for the total number of students assessed Statewide in a subject area using an alternate assessment. Specifically, the state anticipates that it will exceed the cap under paragraph (c)(2) with respect to any subject for which assessments are administered under §200.2(a)(1) in any school year, and is requesting, pursuant to 34 C.F.R §200.6(c)(4), that the Secretary waive the cap for the relevant subject for one year.

Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will submit a waiver from the requirement under Sec. 1111(c)(4)(E), to calculate the academic achievement score of the accountability model under Sec. 1111(c)(4)(B)(i) based on 95% of students in a school when the actual percentage of students participating is less than 95%. This waiver applies to only the high school reading and mathematics assessments under Sec. 1111(b)(2)(B)(v)(I)(bb) where students were unable to participate in required tests in the 2020-21 school year. Since North Carolina uses a cohort model for participation in high school (reading at grade 10 and mathematics at grade 11), test participation from the 2020-21 school year will have a negative impact on the schools that were unable to assess at least 95% of students in the 2020-21 school year.

Perkins Career and Technical Act of 2019 Section 122 (a)(4) and North Carolina General Statues (115C Article 10), public hearings on the state plan for Career and Technical Education will be conducted for the purpose of providing opportunities for interested citizens to express their views on (a) the goals reflected in the state plan; (b) the program to be offered in the plan; (c) the allocation of responsibility for programs to be offered in the various levels of education and instruction; (d) the processes for transactions to fully comply with the Perkins Act of 2019 and the allocation of local, state, and federal resources to meet these goals.
