Title I, Part D, Subpart 2

The Part D, Subpart 2 Local Educational Agency program provides funds to LEAs with high proportions of youth in local neglected or delinquent facilities. Funds can be used for drop-out prevention programs for at-risk youth.

Subpart 2:  Purpose

Support the operation of PSU programs that involve collaboration with locally operated Neglected or Delinquent facilities

  • to carry out high quality education programs to prepare children and youth for secondary school completion, training, employment, or further education;
  • to provide activities to facilitate the transition of such children and youth from the correctional program to further education or employment; and
  • to operate programs which may serve at-risk children and youth

Subpart 2: Eligible PSUs 

PSUs with a local facility for Neglected or Delinquent students located within their attendance zone are eligible for Subpart 2 funds.

  • Delinquent Institution
    • A public or private residential facility operated for the care of children who have been adjudicated as delinquent, or in need of supervision.
  • Neglected Institution
    • A public or private residential facility, other than a foster home, operated primarily for the childcare of children who have been committed or placed in the institution due to abandonment, neglect, or death of their parents..

Subpart 2:  Eligible Students to Receive Services

Students in Local N or D Facilities

  • Students in a public or private residential facility, other than a foster home,
    • operated for the care of children who have been adjudicated as delinquent, or in need of supervision
    • operated primarily for the childcare of children who have been committed or placed in the institution due to abandonment, neglect, or death of their parents
  • “At-Risk” Students in PSU
    • Students at-risk of academic failure, dependency adjudication, or delinquency adjudication.  Any student who has a drug or alcohol problem, is pregnant or is a parent, has come into contact with the juvenile justice system or child welfare system in the past, is at least 1 year behind the expected grade level for the age of the individual, is an English learner, is a gang member, has dropped out of school in the past, or has a high absenteeism rate at school.

Transitional and supportive programs operated in local educational agencies under this subpart shall be designed primarily to meet the transitional and academic needs of students returning to local educational agencies or alternative education programs from correctional facilities. Services to students at-risk of dropping out of school shall not have a negative impact on meeting such transitional and academic needs of the students returning from correctional facilities.

Subpart 2:  Transition Services (SEC. 1422)

A local educational agency that serves a school operated by a correctional facility is not required to operate a program of support for children and youth returning from such school to a school that is not operated by a correctional agency but served by such local educational agency, if more than 30 percent of the children and youth attending the school operated by the correctional facility will reside outside the boundaries served by the local educational agency after leaving such facility.

Special Rule

  • If more than 30%of youth in N or D facility reside OUTSIDE boundaries served by the PSU (after leaving such facility), the PSU is not required to operate a program of support for children and youth returning from the N or D facility.
  • If 30% or less of youth in N or D facility reside OUTSIDE boundaries served by the PSU (after leaving such facility) the PSU is required to operate a program of support for children and youth returning from the N or D facility.
