In compliance with Chapter 115C, Article 2A of the North Carolina General Statutes, the State Board of Education (“SBE”) hereby gives notice of its intent to exercise its rule-making authority to take the following actions:

Re-Adopt:
16 NCAC 06B .0103 (Local Policies for Public School Transportation Programs)
16 NCAC 06B .0107 (Evaluation of Public School Transportation Programs)

Reason for Proposed Action

To comply with statutory requirements that the SBE periodically review and re-adopt rules issued under its authority, the SBE proposes to re-adopt two rules governing public school transportation systems operated by local school administrative units. Rule 16 NCAC 06B .0103 requires each local board of education to adopt and implement certain policies, rules, and regulations governing its public school transportation system. Rule 16 NCAC 06B .0107 requires local school administrative units to cooperate with efforts by the Department of Public Instruction to evaluate those systems. The SBE has proposed technical revisions to each rule but no substantive changes.
   

Public Comment

The SBE will hold a public hearing on this proposed rule via WebEx on May 23, 2025 at 9:00 AM. Members of the public may access the public hearing using the information at the bottom of this notice.

The SBE will also accept written comments via mail and email until June 30, 2025. Written comments may be submitted to:

Public Notice

Decennial Rule Review: 16 NCAC 06 - Elementary and Secondary Education

In accordance with G.S.§ 150B-21.3A the State Board of Education (SBE) is accepting public comments on rules deemed unnecessary.  Unnecessary means a rule the SBE has determined to be obsolete, redundant, or otherwise not needed - G.S.§ 150B-21.3A(a)(6).  

Public comment is defined by G.S. 150B-21.3A(a)(5) as a written objection to all or part of a rule.  Additionally, pursuant to G.S. 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in G.S. 150B-21.9(a).
