Equitable Services for Private Schools CONTACT: Talbot Troy 984-236-2797 The Every Student Succeeds Act (ESSA), which reauthorizes the Elementary and Secondary Education Act (ESEA), requires that an LEA shall, after timely and meaningful consultation with appropriate private school officials, provide eligible private school children, on an equitable basis, services that address their academic needs. The LEA must also provide support services for the teachers and other educational staff and families of the participating children. Information regarding the consultation process and the provision of equitable services may be found in the resources listed below. Draft Equitable Services Guidance from USED The US Department of Education has released a draft of its updated general provisions guidance for ESEA equitable services and is asking for public comment through the end of this month. The 90-minute sessions were offered on two occasions repeating the content of the webinar. Within reason, districts may decide to set earlier deadlines. However, the deadlines should give private schools ample time to make arrangements. *Mar 21: The district sends the first invitations to private schools within its attendance areas for the annual initial consultations. If the district is aware of out-of-district schools that likely enroll students who will impact its Title I-A proportionate share, those schools should also be invited. Any second invitations for non-responsive schools should be sent a week to ten days after the first invitation. Apr 15: The district should set an RSVP date that is no later than April 15. This should be clearly indicated in the invitations. Apr 21: Annual initial consultations should be conducted by this date. Follow-up consultations may be needed to clarify details, but these should be done within a week of the initial consultation and may also be subject to reasonable deadlines set by the district. Ongoing consultations for the implementation of services will be conducted as needed throughout the school year. *Apr 30: The district must notify other districts if, during initial consultations with its local private schools, it learns of inter-district students who may affect the other districts’ Title I-A proportionate share calculations. The notification must list the private schools where inter-district children are enrolled and the contact information for those schools. Districts should promptly invite any such out-of-district private schools to consult if they have not already done so, arranging a special meeting for this purpose if needed. Additional details about students counts will be secured by the district-of-residence if the private schools do consult. May 21: Private schools that intend to participate in equitable services must complete the Affirmation form and provide all necessary information to the district(s) for determining proportionate share. May 30: All proportionate share calculations based on planning allotments should be complete for the upcoming school year. When allotments are adjusted to actual, the proportionate share will also be adjusted accordingly. * These deadlines are required by DPI. The others are strongly recommended.
