Rules (APA)
Pursuant to Article IX of the North Carolina Constitution, the North Carolina State Board of Education (NCSBE) is responsible for "supervising and administering the free public school system and the educational funds provided for its support." The State Board of Education adopts rules in furtherance of its constitutional mandate.
This web page contains rules adopted by and proposed by the NCSBE. The website also offers the public an opportunity to participate in the development of all proposed NCSBE rules by providing comments and requesting public hearings.

Decennial Rule Review: 16 NCAC 06 - Elementary and Secondary Education
In accordance with G.S.§ 150B-21.3A the State Board of Education (SBE) is accepting public comments on rules deemed unnecessary. Unnecessary means a rule the SBE has determined to be obsolete, redundant, or otherwise not needed - G.S.§ 150B-21.3A(a)(6).
Public comment is defined by G.S. 150B-21.3A(a)(5) as a written objection to all or part of a rule. Additionally, pursuant to G.S. 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in G.S. 150B-21.9(a).
