In compliance with Section 150B-21.2 of the North Carolina General Statutes, the State Board of Education (“SBE”) hereby gives notice of its intent to repeal the following subchapters of Title 16, Chapter 6 of the North Carolina Administrative Code:

Subchapter I (The Governor Morehead School)
Subchapter J (North Carolina Schools for the Deaf)
Subchapter K (Education Services for the Deaf and Blind)

This action is being taken pursuant to a recent legislative enactment by the North Carolina General Assembly, Session Law 2023-10. The anticipated effective date of the proposed repeal is August 1, 2024.

The SBE will hold a public hearing on this proposed rule via WebEx on May 31, 2024, at 10:00 a.m. Members of the public may access the public hearing using the information at the bottom of this notice.

The SBE will also accept written comments via mail and email until May 31, 2024. Written comments may be submitted to:

Decennial Rule Review: 16 NCAC 06 - Elementary and Secondary Education

In accordance with G.S.§ 150B-21.3A the State Board of Education (SBE) is accepting public comments on rules deemed unnecessary.  Unnecessary means a rule the SBE has determined to be obsolete, redundant, or otherwise not needed - G.S.§ 150B-21.3A(a)(6).  

Public comment is defined by G.S. 150B-21.3A(a)(5) as a written objection to all or part of a rule.  Additionally, pursuant to G.S. 150B-21.3A(c)(2), in order for the Rules Review Commission to determine whether the public comment has merit, the public comment must address the specific substance of the rule and address any of the standards of Commission review, as set forth in G.S. 150B-21.9(a).
