North Carolina Department Of Public Instruction Request For Waivers To Title II, Part D Tydings Amendment

Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will request a waiver of section 421(b) of the General Education Provisions Act (GEPA) (the "Tydings Amendment") from the United States Department of Education as it affects the authority of the NCDPI and its sub-recipients to obligate fiscal year (FY) 2016 regular funds after September 30, 2018. Specifically, NCDPI is requesting that the authority to obligate funds for the State-administered Elementary and Secondary Education Act (ESEA) program listed below be extended to September 30, 2019.

Notice is hereby given that the North Carolina Department of Public Instruction (NCDPI) will request a waiver of section 421(b) of the General Education Provisions Act (GEPA) (the "Tydings Amendment") from the United States Department of Education as it affects the authority of the NCDPI and its sub-recipients to obligate fiscal year (FY) 2016 regular funds after September 30, 2018. Specifically, NCDPI is requesting that the authority to obligate funds for the State-administered Elementary and Secondary Education Act (ESEA) program listed below be extended to September 30, 2019.

  • CFDA 84.366B Title II, Part B: Mathematics and Science Partnerships Program, Section 2201-2203 of the Elementary and Secondary Education Act of 1965 as amended by No Child Left Behind Act of 2001 (P.L. 107-110); 20 U.S.C. 6661-6663

Continued use of available funds will allow NCDPI and Local Education Agencies (LEAs) to reschedule activities postponed due to Hurricane Florence and retain personnel who are vital to finalizing the professional learning activities designed to improve student outcomes in mathematics and science. Specifically, the funds will be used to continue supporting the partnerships between the Institutions of Higher Education and the high-needs LEAs to improve the content knowledge and pedagogical knowledge of teachers. The State believes that the requested waiver will result in high-quality instruction for students, improved academic achievement of students, and continued assistance for populations in the high-needs districts served by the program for which the waiver is being requested in accordance with applicable program requirements. No new initiatives will be implemented.
